Be Your Own Lawyer, Even If You Have One
As with all professionals, there are good ones and bad ones. We are not mind readers and cannot always know the difference. What we are then left to do is fend for ourselves and always remember that your lawyer, even Public Defender, works for you.
While it is always a wise decision to have a lawyer when going into a courtroom, it doesn’t always do a lot of good. Having a good attorney is the ideal situation but how do you know if they’re good or not until you try them and then it may be too late. Defending oneself isn’t always a good idea either; the law is a tricky thing and can soon turn against us. The solution is to not take that chance. You need the lawyer and the knowledge.
Whatever your going to court for, find out about those types of cases; the possible penalties, fees, jail time, defenses or prosecutions, etc. Find out about the law regarding the case and how other judges in your state of jurisdiction have handled a similar case and specifically how your judge typically handles them. These should give you a good indication of what to expect and how to help prep your lawyer.
Let your lawyer know you’ve done your research and have supporting documentation. Make it clear that you are in control and are giving them the right to speak for you based on their knowledge of the law but that you retain the right for certain subject matter to be covered as you see fit. Have whatever evidence available at your attorneys disposal. In most cases, your attorney will do whatever is customary for them to do in any given situation. Trust them with the basics but make sure your lawyer explains exactly what is being said and what it means. No lawyer can get out of law school without knowing a little law.
Remember, your lawyer probably handles a lot of cases. Be patient, be respectful and listen to what they are saying. They often talk, “between the lines”, to give some valuable, added advice. If you believe that your lawyer is not handling your case properly, you have every right to fire and replace them. No one cares as much about you in a court of law than you. Be prepared.
